FEDERAL GOVERNMENT OF SOMALIA DECISION OF THE FEDERAL GOVERNMENT OF SOMALIA REGARDING THE INFRINGEMENT OF THE GOVERNMENT OF
ETHIOPIA ON THE SOVEREIGNTY OF SOMALIA
The Council of Ministers of the Government of the Federal Republic of
Somalia in its extraordinary meeting number: SHGW058.01.2024 held on 02
January 2024, presided over by the Prime Minister of the Federal Government of Somalia issued a resolution on the violation of the Ethiopian Government on sovereignty and territorial unity in Somalia.
AFTER HAVING SEEN:
Article 1, paragraphs 1 and 2 of the Constitution of the
Federal Republic of Somalia, which states that Somalia is a
democratic, Federal Republic; and that the sovereignty and
unity of the Federal Republic of Somalia is inviolable.
AFTER HAVING SEEN:
Article 7, paragraph 1 of the Constitution, which states that
” The sovereignty of the Federal Republic of Somalia
extends over all the territory of the Federal Republic of
Somalia, which includes the land, territorial sea, the islands,
the subsoil, the air space, and the continental shelf, and any
land and waters that join the Federal Republic of Somalia
in accordance with a law that shall be passed by the Federal
Parliament.” AFTER HAVING SEEN: Articles 53rd and 54th of the Constitution grants the Federal Government of Somalia the legitimate right to enter into
international agreements especially in matters related to
foreign affairs, economy, national defence, and security
which require the approval of the Federal Parliament of
Somalia.
AFTER HAVING SEEN: Article 51, paragraph 4 of the Constitution, which states that “All levels of government must comply with the
national Constitution, without any government assuming
more powers than the Constitution allocates.”
AFTER HAVING SEEN:
Article 2 paragraph 4 of the Charter of the United Nations
about the inviolability of political sovereignty and territorial
integrity of a country and the United Nations General
Assembly Resolution number 2625 which stipulates that ”
No State may use or encourage the use of economic,
political or any other type of measures to coerce another
State in order to obtain from it the subordination of the
exercise of its sovereign rights or to secure from its
advantages of any kind.” AFTER HAVING SEEN:
The principles of sovereignty and unity of the African
states are ruled by the African Union Charter “OAU” and
the African Union Constitutive Act “AU” of 2002 and that
of the IGAD Regional Organisation.
The Government of the Federal Republic of Somalia issued the following resolutions: 1. The Federal Government of Somalia strongly rejects and expressly opposes the
harrowing move of the Federal Government of Ethiopia to reach the so-called
“Memorandum of Understanding of Partnership and Cooperation” yesterday
on 01/01/2024 in Addis Ababa with Somaliland (Northern Regions of Somalia) According to the Constitution of the Federal Republic of Somalia, the laws of the country and the international laws – Somaliland is part of the Federal Republic of Somalia.
- The Federal Government of Somalia considers this action as an aggression and threatens and is an impediment to the good neighbourliness, peace and stability of the region which has already struggling with many challenges and is a blatant violation and interference on the independence, sovereignty, and unity of the Federal Republic of Somalia.
- The so-called “Memorandum of Understanding of Partnership and
Cooperation ” is null and void, has no legal basis, and is unacceptable to the
Federal Government.
- The Federal Government of Somalia warns the Federal Government of Ethiopia
against any attempt to violate the sovereignty, independence, and unity of the Federal Republic of Somalia, the Federal Government of Somalia is entitled to respond to the provocative action taken by the Federal Government of Ethiopia through all legal processes and means.
- The Somali government recognises Ethiopia’s actions as a blatant violation of the sovereignty and territorial integrity of the Federal Republic of Somalia.
- The Somali government, with the support of its people, is ready to defend, protect and preserve the sovereignty, dignity, territorial integrity, and social unity of its people.
- The Somali government demands the United Nations’ Security Council (UNSC), the African Union (AU), the Organisation of Islamic Cooperation (OIC), the Arab League, IGAD and other partners who promote regional peace and stability, while protecting the rules they are based on, and fulfilling their duties, to stand by Somalia’s right to protect its territorial integrity, and to demand Ethiopia to return to the confines of international laws.
- The Somali government demands the United Nations’ Security Council and the African Union to convene urgent meetings to discuss Ethiopia’s aggression and interference against the sovereignty of the Federal Republic of Somalia.
- In response to this, the Federal Government of Somalia is recalling its
ambassador to Ethiopia for urgent consultation.
Finally, the Government of the Federal Republic of Somalia will issue the necessary orders to protect its sovereignty and prevent violations against it, all government agencies and the Somali people are instructed to enforce this decision.
